Terms of Service

These terms are an agreement between you and Flux Developments Ltd, a company registered in England and Wales ("we", "us", "our"), covering your use of the SideOut mobile application (the "App") on iPhone and Android. By downloading or using the App you accept these terms. If you do not accept them, do not use the App.

How we handle your personal information is set out separately in our privacy policy.

1. Your right to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own use and the use of your club or team. You may not copy, sell, rent, sub-licence, reverse engineer or attempt to extract the source code of the App, except to the extent that law expressly permits it.

2. Your account

The App creates an anonymous account automatically so you can start using it immediately. You can upgrade to a full account with an email address or with Sign in with Apple. You are responsible for keeping your sign-in details secure and for activity carried out under your account.

You must be at least 13 years old to hold a SideOut account. See section 11.

We may suspend or close an account that is being used unlawfully, to abuse or harass other users, or in breach of these terms.

3. What SideOut costs

SideOut is free to download, and scoring, scoresheets, sessions, tournaments, your SideOut level and rating, and SideOut Clubs are free to use.

3.1 SideOut Pro

SideOut Pro is an optional paid subscription that adds full analytics, unlimited match history with a point-by-point flow, unlimited tournaments and the shareable SideOut Wrapped card. Your SideOut level and rating are deliberately not part of Pro and remain free for everyone.

3.2 Free trial

SideOut Pro includes a 14-day free trial. The trial runs from the date you install the App. Pro features are available in full during the trial. When the trial ends, Pro features stop working unless you take out a subscription. Your match history, club data and everything else you created remains yours and stays in the App: only the Pro features lock.

One free trial is available per person. We may withdraw or vary trial offers for new users at any time, but doing so will never shorten a trial you have already started.

3.3 Prices

• Monthly: £2.49 per month.
• Annual: £19.99 per year.

Prices include VAT where applicable. The price shown in the App at the point of purchase is the price that applies. If you are outside the United Kingdom, your app store will show the equivalent price in your local currency, which is set by Apple or Google and may differ from a direct conversion.

3.4 How payment is taken

All payments are taken by Apple through the App Store, or by Google through Google Play, depending on which version of the App you are using. We never take payment directly and we never receive your card or bank details. Your purchase is also subject to the terms of whichever store you buy through.

3.5 Automatic renewal

Subscriptions renew automatically. A monthly subscription renews every month and an annual subscription renews every year, at the price then in effect, until you cancel. Your store charges the renewal within 24 hours before the end of the current period. If you take out a subscription during a free trial, the first charge is taken when the trial ends, unless you cancel before then.

3.6 Cancelling

You can cancel at any time, and you do not need to contact us to do it:

• iPhone: Settings → your name → Subscriptions → SideOut → Cancel Subscription.
• Android: Google Play → your profile → Payments and subscriptions → Subscriptions → SideOut → Cancel.

Cancel at least 24 hours before the end of the current period, or the next period may still be charged. When you cancel, Pro stays active until the end of the period you have already paid for, and then stops. Deleting the App does not cancel a subscription, and neither does deleting your SideOut account: you must cancel through your store.

3.7 Refunds

Because Apple and Google take the payment, they also handle refunds. Request a refund through reportaproblem.apple.com for the App Store, or through Google Play's order history. We cannot issue a refund for a purchase we did not process, but if something has gone wrong please contact us and we will help you sort it out and support your request where it is justified.

If you are a consumer in the UK, you normally have a 14-day right to cancel a digital purchase. By starting a subscription and getting immediate access to Pro features you agree that supply begins straight away, and you acknowledge that this right to cancel is lost once supply has begun. This does not affect your legal rights if the App is faulty, not as described, or not supplied with reasonable care and skill.

3.8 Price changes

We may change subscription prices. If we increase the price of your existing subscription, we will tell you in advance through the App or by email, and your store will also ask you to confirm before charging the new price. If you do not agree, cancel before the change takes effect.

3.9 Club subscriptions

We intend to offer a paid club plan, billed to the club rather than to individual members. It is not available yet. When it launches it will have its own terms, which we will publish here, and taking one out will not change the price of an individual Pro subscription. Club members are not automatically given Pro.

4. Your content

Match records, team names, session details, comments, lineups, coaching notes, photos and everything else you enter into the App remain yours. You give us a limited licence to store, copy and display that content solely so that we can operate the App for you and show it to the other people you have chosen to share it with, such as members of your session or your club.

You are responsible for what you enter. In particular, you must have a proper reason to enter another person's details, and you must not upload anything unlawful, abusive, or infringing someone else's rights.

5. Clubs and coaching notes

Where a club uses SideOut Clubs, the club decides who is admitted, what role each member holds, and what its coaching staff write about players. The club is responsible for the accuracy and appropriateness of that content and for complying with its own safeguarding and data protection obligations, particularly where under-18 players are involved. We provide the tools, not the judgement.

Club admins can remove members and delete sessions, lineups and notes. If you leave a club, that club continues to control the records it holds about your time there. See our privacy policy for how to ask for those records to be removed.

6. Acceptable use

You must not:

• Use the App to harass, bully, impersonate or abuse anyone.
• Attempt to access another person's account, club or data.
• Probe, scan or interfere with the App or our infrastructure, or try to circumvent access controls or payment.
• Use automated means to extract data from the App.
• Use the App for anything unlawful.

7. Availability

We aim to keep SideOut working and available, but we do not guarantee uninterrupted service. Scoring and match history work offline by design; features that need our backend, including SideOut Clubs, need a connection. We may change, suspend or withdraw features. If we withdraw a Pro feature you are paying for and do not replace it with something comparable, you may cancel and we will support a pro-rata refund request with your store.

8. Accuracy and sporting decisions

SideOut is a tool for recording matches. Scoresheets, ratings, seedings and statistics are generated from what is entered into the App, and we do not warrant that they are free of error. They are not a substitute for the decisions of match officials or the rules of your competition. Always check a scoresheet before signing it.

9. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Nothing in these terms affects your statutory rights as a consumer.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or loss of data where that loss was not reasonably foreseeable. Our total liability to you in connection with the App is limited to the greater of the amount you have paid us in the 12 months before the claim, or £50.

The App is provided as it is and as available, save for the guarantees implied by law that cannot be excluded.

10. Ending this agreement

You can end this agreement at any time by deleting the App and, if you have one, cancelling your subscription. We may end it if you materially breach these terms, and where it is reasonable to do so we will warn you first. Sections covering your content licence, liability and governing law survive the end of this agreement.

11. Age

SideOut is not intended for children under 13. Clubs run junior and youth squads, and where a club adds a player under 18 to a team, the club is responsible for having appropriate consent from a parent or guardian.

12. Changes to these terms

We may update these terms. When we make a significant change we will update the date at the top of this page and tell you in the App. Continued use after a change takes effect means you accept the updated terms. Changes will never apply retrospectively to a subscription period you have already paid for.

13. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own local courts.
